The European Union's Carbon Border Adjustment Mechanism (CBAM) crossed a historic threshold on January 1, 2026, entering its definitive enforcement phase and instantly becoming the world's first fully operational carbon border tax. Importers of steel, aluminium, cement, fertilisers, hydrogen, and electricity must now purchase carbon certificates priced at €75.36 per tonne of CO₂ for the first quarter—mirroring the EU Emissions Trading System (ETS) price—with the first quarterly compliance declarations due. Covering roughly €50 billion in annual imports, the policy is already triggering trade friction, spurring retaliatory threats, and accelerating the adoption of similar carbon pricing mechanisms from Canada to Australia.
What Is CBAM and Why Does It Matter Now?
The Carbon Border Adjustment Mechanism is the EU's flagship tool to prevent "carbon leakage"—the risk that EU-based industries relocate production to countries with weaker climate policies, undermining Europe's green transition. Legislated as part of the European Green Deal, CBAM entered into force on 17 May 2023, followed by a transitional reporting-only phase from October 2023 to December 2025. The definitive phase, launched on 1 January 2026, imposes real financial obligations. Importers must hold "authorised declarant" status and surrender CBAM certificates corresponding to the embedded emissions in their goods. Iron and steel dominated, accounting for 98% of the 1.655 million tonnes covered, with fertilisers, cement, and aluminium making up the remainder.
The 2026 Phase-In: From Symbolic to Serious
While 2026 marks the start of real payments, the financial burden is phased in gradually. A "CBAM factor" limits liability to just 2.5% of embedded emissions this year, rising steadily to 100% by 2034—when free allowances for EU domestic producers are fully eliminated. The policy framework also expanded rapidly. WTO legality hinges on whether CBAM can satisfy GATT Article XX environmental exceptions without constituting arbitrary or unjustifiable discrimination. Legal scholars note that the mechanism may violate Most-Favoured-Nation obligations by favouring countries with established carbon pricing, while its complex verification requirements disadvantage exporters with limited administrative capacity.
